Employment: Holiday pay revisited

Employers are still uncertain of how to calculate pay

The uncertainty for employers on how to calculate holiday pay continues. The Court of Appeal in Northern Ireland held, in June 2015, that there was ‘nothing in principle’ to prevent inclusion of voluntary overtime from calculations. Potentially, this widens the principle which applied to non-guaranteed compulsory overtime following the case involving road maintance service provider Bear Scotland (Bear Scotland Ltd and others v Fulton and others).
